Contentious Probate or Disputes Over Wills

After someone that you care about dies it is usual for their personal affairs to be sorted out quickly and without challenge. However, there may be issues about the wishes of the deceased in relation to property left by them.

 

You may consider that a Will is invalid or suspect that the deceased was not fully involved in making the Will. If you feel strongly that the Will does not carry out the true wishes of the deceased for a number of reasons you have a right to challenge the Will.

 

Our team offer practical and sensitive advice to both executors, trustees and potential or actual beneficiaries on a full range of issues arising out of disputed Wills or a dispute in relation to a testamentary gifts.

 

Advice can be given in relation to:

 

Claims regarding the validity or otherwise of Wills. This may include challenges to a Will based on capacity issues, lack of knowledge and approval, undue influence, fraud and forgery and a failure to comply with the formalities of execution, and

 

Claims by Potential or disappointed beneficiaries. This may include claims under the Inheritance (Provision for Family and Dependents) Act 1975 or claims arising out of the ownership of property which a beneficiary believed had been promised to him/her on the testators death.
